No, you should not be concerned. This Prop 65 warning is on just about every product on the market. California seems to think that everything causes cancer. You can safely ignore the warning.

my pen says made in Taiwan, isn't it supposed to the made in USA?

It says "Taiwan" in the "product details", at least at this time. Further, it says the manufacturer is Taylor Brands LLC. That stinks. Bring back American manufacturing for American products.

can you use fisher ink in it

Does the cap come unscrewed on it's own? I kept my last tac pen on a lanyard with my keys and after a while was left with only a cap.

The cap on this pen "screws" onto the body. Although it has an o-ring between the cap and the body (which makes inadvertent cap removal less likely), it is still possible...although very unlikely if you tighten the cap. However, neither the cap nor the body has a hole for a lanyard, and the clip is not designed for that use.
